NDAA Section 889 Compliant Transceivers

What is NDAA Section 889?

Section 889 of the 2019 National Defense Authorization Act prohibits federal agencies from procuring or using certain Chinese-made telecommunications and video surveillance equipment. It has two parts: Part A bans agencies from buying covered equipment, and Part B bans agencies from contracting with organizations that use it in their own operations.

Part B is the reason the rule reaches well beyond federal agencies. Contractors, subcontractors, and suppliers who want to keep federal work need their own networks free of covered equipment, so the requirement flows down through the supply chain to companies that never sell to the government directly.

Which companies are covered by Section 889?

The statute names five entities, along with their subsidiaries and affiliates:

• Hangzhou Hikvision Digital Technology
• Dahua Technology Company

Are Coretek Opto transceivers Section 889 compliant?

Yes. Coretek Opto is an independent Taiwanese optical component manufacturer, established in 1997, with no ownership, affiliation, or supply relationship with any covered entity. Its transceivers incorporate no covered telecommunications equipment.

What is the difference between TAA and NDAA compliance?

They test different things. TAA is a country-of-origin rule: the product must be made, or substantially transformed, in the US or a designated country. Section 889 is an entity-basedban: five named Chinese companies are prohibited regardless of where their products are manufactured.

Are these transceivers made in China?
